Welcome to TRUCKS365 INC. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Description of Services
TRUCKS365 INC is a third-party logistics (3PL) provider offering comprehensive freight transportation and logistics services, including but not limited to:
- Full Truckload (FTL) and Less Than Truckload (LTL) shipping
- Refrigerated and temperature-controlled transportation
- Expedited shipping services
- Oversize and heavy haul transportation
- Warehousing and distribution
- Freight brokerage and logistics management
3. User Obligations
By using our services, you agree to:
- Provide accurate and complete information about your shipments
- Ensure all goods comply with applicable laws and regulations
- Properly package and label shipments according to industry standards
- Disclose any hazardous materials or special handling requirements
- Pay all fees and charges in a timely manner
- Comply with all applicable transportation laws and regulations
- Not use our services for any illegal or unauthorized purposes
4. Prohibited Items
We reserve the right to refuse transportation of the following items:
- Illegal substances or contraband
- Hazardous materials without proper documentation and authorization
- Perishable goods without appropriate packaging
- Items that violate intellectual property rights
- Living animals (unless specifically authorized)
- Items prohibited by federal, state, or local regulations
5. Pricing and Payment
Pricing for our services is based on various factors including distance, weight, dimensions, service level, and special requirements. Payment terms include:
- Quotes are valid for 30 days unless otherwise specified
- Payment is due within 30 days of invoice date unless otherwise agreed
- Late payments may incur interest charges
- We reserve the right to require prepayment or deposits
- All prices are subject to fuel surcharges and applicable taxes
6. Liability and Insurance
TRUCKS365 INC maintains appropriate insurance coverage for transportation services. However, liability is subject to the following limitations:
- Our liability is limited to the actual value of the goods or $0.60 per pound, whichever is less, unless additional insurance is purchased
- We are not liable for delays caused by acts of God, weather, traffic, mechanical failures, or other circumstances beyond our control
- Claims must be filed within 9 months of the date of shipment
- Consequential, incidental, or special damages are excluded
- Customers are encouraged to purchase additional cargo insurance for high-value shipments
7. Claims Process
To file a claim for loss or damage:
- Notify us in writing within 9 months of delivery or expected delivery date
- Provide complete documentation including bill of lading, invoice, and proof of loss
- Allow reasonable time for inspection of damaged goods
- Preserve damaged goods and packaging for examination
- Claims will be processed according to federal transportation regulations
8. Delivery and Transit Times
Transit times are estimates only and are not guaranteed unless specifically agreed to in writing. TRUCKS365 INC is not liable for delays in transit or delivery. Customers will be notified of any significant delays when possible.
9. Cancellation and Rescheduling
Cancellation and rescheduling policies:
- Cancellations must be made at least 24 hours before scheduled pickup
- Late cancellations may incur charges
- Rescheduling is subject to availability and may incur additional fees
- We reserve the right to cancel services due to safety concerns or non-compliance
10. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of TRUCKS365 INC and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Confidentiality
We maintain the confidentiality of your business information and shipping details. However, we may share information as necessary to fulfill transportation services, comply with legal obligations, or protect our rights.
12. Indemnification
You agree to indemnify and hold harmless TRUCKS365 INC from any claims, losses, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
13. Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved as follows:
- Initial good faith negotiation between parties
- Mediation if negotiation fails
- Binding arbitration in accordance with applicable rules
- Litigation in the courts of Illinois if arbitration is not successful
14. Governing Law
These Terms are governed by the laws of the State of Illinois and applicable federal transportation regulations, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and TRUCKS365 INC regarding the use of our services and supersede all prior agreements and understandings.
